I for me to all opposed 5 in favor. None opposed the consent agenda is adopted. Item. 22 ordinance 26 dash. 38 administrative ordinance establishing Qualifications and examining committee for the position of Fire chief. Pursuant to the provisions of Section 9.1, a of the administrative Code and Section 12012.1 of the Saint Paul City charter. All right. So now we're in ordinance section of the agenda. I do want to give bit of for ordinances. Usually it appears for the council for 3 readings. So the first week it would be when we have a staff report. Second reading is when a public hearing happens and then for the 3rd week we can and vote on it, orderly it over for more discussion.

So the only ordinance related item that we have for today, it's under public hearings. So I do want to open up the floor for the public hearing. If you are here to testify on this item, please come on up to the podium. Just bit in full of all public hearings, folks who come and testify, you get 2 minutes. So bottom line up on both sides of the microphone as chair, what your name is where you're coming from. if you're here test to testify, please make sure that you to stay on topic with agenda item for speaking about. So come on up in here to testify.

They are. Well, yeah, will be later. We are. And number 22 right now. don't see anybody out. So I do. I want to open up the floor for discussion amongst our colleagues are any questions that you have? I have a couple of quick comments to make. Councilmember Johnson. Just a quick comment. Quick comment on the overall process. Just want to say thank you. also been it's been great to be a part of it is one of the council members that has this committee. One thing that I would just encourage also share not to question some of the appointments in any way, but I think for the for the current chief within the Minneapolis Fire Department, want to confirm that that particular seat. I saw that. And just to share that we may need to just make sure that fire chief will be seated for that position to make sure that there. We may want to confirm that as well.

So that something that was 5 for me, recent communications. I just want to make sure that that is that that is indeed confirmed and that we have the latest on that because i not, we may want to consider term. But just given some of the business in Minneapolis, I want to make sure that we can confirm that person's appointment. Thank you. Concert on Sen. I am just the comments that I wanted to make its I first wanted to express gratitude to council member Johnson country can 4 the partners mean the charge to stumble or sleet here. I also want to just point out that the the slate look at it. very, very proud of it. It's a very strong slate that represents a diverse group of Saint Paul residents. Community leaders and are subject matter. Experts, especially in the fire field. It's a slate that is very diverse across and each tent are experience too.

I want to give a shout out to the many different partners that we engage with them on the way from HR and director to Chrissy and then also with the many staff who are a part of sir, providing a lot of really important support, Iran, diligent logistics, especially from council. Our council director geelong's to Nicole as city clerk, the city attorney Dan right next to me Greg as well. And then too. m legislative aide and then a big things to council members and all of your legislative aides. You are part of providing really valuable input for us to get this late together. And thanks to that. Make me partners who answered whenever want to get their input and connect with them. About the slate. Overall. I wanted to give a special shout out to our PA firefighters Union for providing really valuable input. And again, overall just wanted emphasize that this is this ee and very confident and that they are going to be tasked a lot of important work, especially in reviewing application materials resumes from HR and then area down 5 top candidates to be sent over to the mayor so that she can interview with them and then ultimately and appointment would come to the council here all.

Send excited for the process ahead and making sure that we officially have our next fire chief hopefully some time for the end of the year. All right. yes, a customer can. What are we going you for some now? We haven't close the public hearing. Yeah. So i anybody is here to testify on this item, they can come up to the mic afterwards. This a pre she did. I just want to also extend some gratitude to cause of vice-president yang for leading this process. I'm very supportive of the slate that was constructed. But specifically because I feel like it really represents folks that have not just sort of fire experience but experience specifically with our fire department. We are unique in the way that we are staffed. unique in the way of what office, what services we provide specific there. Paramedic services. So I really just appreciate the thoughtfulness of the approach and the input from all the different experts to help us build a really robust, a really robust panel.

One that has a certain level expertise and housing parts happen. So thank you. Council us Thank you. Just the last couple of things I wanted to share to is. A council member did take note of what you shared earlier. My understanding is everybody on this slate like they have their participation and ability to participate. Overall has been confirmed. But I will make sure to have my staff check with HR department about that. And just a final thank you to all of the individuals on the slate itself every person who was contacted. They were very eager, interested and just really excited about being able get back to Paul in this way. So come on up to the mike. If you are here to testify, have 2 minutes. Share your mean where you're coming from. And then if you can sign in at the end, that be great. My friends. Good afternoon council, president maker Council vice president members of the City Council.

My name is Kyle Foreign Bird and the president Saint Paul Fire fighters. Local 21 and I have the privilege of representing 475 firefighters, paramedics and EMT's who serve this great city. Local 21 is the city's second largest labor union that represents employees exclusively within a single department. I'm here today because local 21 supports ordinance 26 dash. 35 or 38. establishment of the fire chief qualifications and examining committee and proposed slate as a whole. No committee of this size assembled to represent so many interests will be configured exactly as anyone stakeholder might choose. The relevant question is whether the slate brings together the experience, community perspective and professional knowledge necessary to carry out responsibility. We believe it does. And we believe it is time to establish committee and begin the selection process. This is a well-rounded slate. It includes the Saint Paul residents and community leaders, people with experience in healthcare, public safety, state government neighborhood, engagement, current and retired fire service leaders and representatives from workers who perform this work every day.

It effectively connects the expectations of the community. With the operational realities of fire service. Local 21, especially appreciate sadly residential fund influential role in this process. The next fire chief's decision will determine. Companies are staffed and Members are trained and equipped and whether the people answering these calls have the resources and support necessary to return home safely to their families. Our members spend more time inside the fire department than nearly anyone else without sample firefighters. That's a big red trucks. The fire stations are just hollow shells. My members carry generations of institutional knowledge and they see immediately went to policy succeeds or fails in the street in a profession where consequences are measured in seconds and lives. Worker input is neither symbolic marker to see. it's operation. se the next fire chief inherit one of Minnesota's busiest and most complex, all hazards, fire and EMS systems. Just last month, overall responses were 8% higher than the same month in 2025.

With the fire response is increasing. But for time well, you might time. Thank the council to. ordinance. Thank Thank you so much. Motion from concert him to close the public hearing and leave this matter over until next week. All in favor. All opposed 6 in favor and opposed. ordinance is laid over for final adoption. Item, 23 resolution public hearing 26 dash one. 49 approving the establishment of the couple used a special sanitary sewer availability connection charge, dstrict determining the couple used a special sanitary sewer availability connection charge for phase one and to sewer capacity improvements. a public hearing. If you here to testify, come to the microphone. Seeing none. I'll take motion for help. Come on. We get 2 minutes charity or you're coming from. And they signed in afterwards, OK, my name is Barbra Homes and I live in the como Eustis area that's indicated on this established couple used a special sanitary sewer availability connection charge District.

I'm one of the residents homeowner in that area received a notice about this district. I can speak on behalf of my household and some of my neighbors that we were a bit confused as to what all meant. Our understanding after rereading and conversing and talking to somebody with the city is that if this proposal passes owners of the new properties being built health partners and the Luther's. Whoever buys Luther Seminary property within this district. Will be responsible for improvements to the old 1918, sanitary lift station and the residents will not be responsible for those improvements. What the notice failed to say is what happens if the proposal doesn't pass.

Our understanding is you city council basically just give blessing to this proposal and there is little chance that it will pass. I would like to just advocate for its passing. I think that it's only fair that those who burden the sanitary sewer that is very old with new development should be responsible those charges. Those cost. Thank you. Thank you. anybody else is here testify, cme on to the front. All right. Seeing none. I will take a motion from customer comment to close the public hearing all in favor. I all opposed to 6 in favor not oppose public hearing is closed. Any discussion on questions? Okay. Scene and then motion from council member Clement for approval on favor. all opposed 6 in favor. None oppose. The resolution is adopted item. 24 resolution public hearing 26 dash one. 58 amending the financing and spending plans in the Department of Parks and Recreation and the aount of 633 $1224 to reflect remaining bond issued interest proceeds received from the Saint Paul Port Authority for the Eap Capital Project.

This is a public hearing. If you're hitter testify, come up to the microphone. Okay. Seeing none. And then I take a motion from comes from Burgess to close the public hearing and approve all in favor. I post 6 in favor. None oppose. The resolution is adopted item. 25 resolution public hearing 26 dash one 94 amending the city's Capital Improvement budget, an operating budget to reflect the final sale. Details resulting from the issuance of the GEO Capital Improvement Bonds series, 2026 P and the geostrategic construction Bonds series 2026 E this is a public here to testify. Come on up to the microphone. Seeing none. I will take a motion from come. Come on up. You get 2 minutes. Sharon E where you're coming from then site afterwards. I why another that and more for I'm here testify that. It's very difficult for the public to weigh in on anything regarding the budget when there's been a expansion of the drone program that the city of Saint Paul is implemented.

With the docking drones and sky Deo which Minneapolis recently rejected in Saint are starting ship out that it isn't about the topic here, though, says that it has to do with the budget. There's we have a quote in the Saint. Paul Pioneer Press for says $300,000 were spent in this. That's an estimate coming from the Saint Paul Police Department. We could find no record the actual contracts that we have no idea what budget is going towards this program. These are weapons of war. That receive. Bring that because that's right. latest sign, the only reason that have second time because they were used to house time and now they're being used in cities across United States. We deserve a public hearing. We deserve transparency on this issue and we deserve disclosure of what that contract actually is before we had any discussions of the budget the public in Q. Thank you for being here. Okay. Anybody else here to testify on this item here?

Yeah. Very reduced rainfall. Life and residents imposes and Paul, I just heard about this issue yesterday. So I don't have any kind of prepared speech, but I'm opposed to this. We do not need groans Saint Paul. W don't need goes in Minneapolis, Jose, going to improve our safety. I just you become we become more and more militaristic. You know, we going repeat this is that on the now said to have cut. Yeah, this state. All right. Thank

Anybody else who could testify in this item come on up. Okay. Seen not.? we see more It and I live in Ward 7. has a Saint Paul. I'm outraged because the library Dayton's Bluff, one of the most underserved communities is being closed. Our unhoused neighbors being not about the items. I won't have its budget. I is being closed because there's no money. Right. It's about budget. And then we neighbors being swept her the same time it

China and no amount of money is being spent Jones. Do we need Jones in saying, quote, When we don't have an educator, our kids don't have access to house people. Okay. I te library jobs how does a don't have computers are being served that way and are it on. trying to move our meeting along. All right. So if I have to give all 3 warnings and I will let you know when I get out a warning, if I had to get to 3 the floors, I will not resist. Yes, I need say this as a single resident that they do not appreciate our libraries being close for lack of budget yet at the same time. Huge amounts of are 2 of you. Okay. Thank you all. Thank you. All right. So on. I don't see anybody else here for the public hearings. So I will take motion customer account to close the public hearing and approve the item all in favor.

I post 6 in favor. None oppose. The resolution is adopted item. 26 resolution public and 26 dash one 97. Authorizing the police department to accept the Second Amendment to the sub grant agreement from the Saint Paul and Ramsey County Domestic Abuse Intervention Project and ADD Grant activity budget. This is a public hearing. Anyone who is here to testify come on to the mic. Hello, my name is Cedar Larson. I live in Ward one a resident of Saint Paul number of women its military madness. I wish that the city was able to truly have safety for victims of domestic abuse. I wish that same poll police are not the people put in charge of this because we know that it's not an insignificant percentage of police that are themselves domestic abusers. I wish that resources to help the domestic abuse crisis could be used for outreach organizations, housing therapy and prevention of domestic abuse as a whole, I know police do not keep us safe and we don't need police to protect women or victims of domestic violence because they don't do that.

Currently, we've seen that police use flock cameras to track their girlfriends, wives and exes and I strongly oppose the use of and contract with Skyview Incorporated as well. These drones and this company have blood on their hands from Palestine to the Philippines.

And we cannot continue to allow Saint Paul to be complicit in these human rights abuses. Safe sky Deo has sent hundreds of drones to the Israeli occupation forces where they rate and abuse Palestinians. The same contact the sky. further enables them to commit genocide in Palestine. WHAM stands firmly against complicity in genocide. And that's exactly what they're doing by continuing to contract with sky you. cannot trust AI powered drones to make our communities safer. Hre. And sky DEO drones would not stop a crime. They arrive to crime scenes after a crime has already happened. And we know that flock in sky. The oaken incorrectly identify suspects and put innocent people in harm's way by the police. No se parked on tracks for and I the contract with Sky Deo and use public taxpayer dollars for real solutions. Not for more funding of police. Thank you. Thank you. Make sure to Come on up to the mic in here to testify.

I my name is Andrew. check. I currently live in Minneapolis, but I'm a former Saint Paul resident. And I really agree with the previous speaker in the pint addressing the root causes the social problems and that the way we dress it with police promise has not been effective. You know, I remember when we're told body cans would be the magic bullet solving issues of police violence. Instead, of course, now we see the is controller body cam footage used to. We don't see the footage shows police violence. We only do use it to see it used to justify police violence. You know, we've been told that facial recognition technology being used across our cities like was flock cameras. And so on. We'll make. It will make community safer. But then with only way seen that is by ICE to terrorize our communities. And the and so for this that reason, you know, I also oppose the contract with Sky DEO has contracts with the Israeli military. actively event at the genocide in Gaza.

Its contract with ICE to surveil, not just immigrants, but people just political opponents of the Trump regime in our cities and whether sales people tell you that these are designed to aid in public safety. All we've seen them unable as genocide. And police tear is the same thing we've seen over and over again and for that reason, I also demand transparency, the contract and the cancellation of the contract. Thank you.? If you here to testify this item, come on up to the fight. Council vice president, I'd like to make a motion to close public hearing. thank you. are. We are getting there. I don't see anybody here. So I am comfortable I taking emotions motion from counselor Johnson to close the public hearing and then with discussion with discussion So but let me do the motion for. I'm all in favor of closing the public hearing. All oppose. 6 in favor oppose the public hearing is closed.

Thank you. Encounter a great it's your hand up. So you. means for the morning. That's me. I do. And I am in favor of people having their public commentary using their voice everything that we do here is related to the budget. Everything that we do here is related to public safety. So I do see we can have avenue in which that people can provide public comment. Just not on these items. I would like to motion and that's why I didn't want to close. This is and have this conversation. Another item I would like to for us to suspend rules and to provide public comment for the people who are here just they can have their public record because right now you can see no eyes are reading the People are here and they want to heard. I think we should bring a structure for to do that. So and if you could have a motion suspend rules and products made out A city like get us into mess.

Is there? Thank you so much for that. Tourney and family. Is there a? We do a motion to put a I guess, public input, which is not a public hearing, and today they're people too provide public comment. It's resolution of staff report, particularly around. I safety investments.

I think that has won a concluded no. I think it's really important for us. That is kind of stations as elected officials are all available to take people's comments and concerns. We have heard this through the e-mails. This has been a a widely known and discussed topic that has public safety chair and also the vice chair public safety here to my right. This is an issue that we anticipate reviewing and also you know, hearing from community. I just want to say for everyone's here, there are people to do business and and have hearing items and there's like certain votes on this. Agenda that we really want to get to. I'm willing stay longer. The top of people. But I just also just would not what it certain people who are using their precious time to make sure that their items are not the case. And awful. vice president again, if you can ensure that public comments on during hearings is related to the items.

You know, we've heard already from the city attorneys that we don't have the ability do that public hearings. I would love to find some time avenue can. And even if it's not a public hearing, least have something on the record and there's other avenues to do that. I can share with people talking council members. Are you knowing there having town halls still engage in process. All right. Thank you, council 3 for sharing your thoughts there. want to say thank you for being somebody who is it's really a Tenet. And Michael Ware, audience and the chambers here. They're here with very real concerns that they're here share with us about and what I hear you. And, you know, the questions that you're asking, my my suggestion would be to do something really similar to what cars Kim and I did in the past during the operation, Metro Surge, I had initiated, having opened a public hearings and having folks come testify to us about Operation Metro Surge.

We had it on the agenda for as long as you know, we had supported and then even not just recently, counselor, it can. But a public hearing on the agenda for folks to come share their concerns about encampment closure. So if that's something that you only interested in doing for next week and you have specific topic that you want to have on the agenda. I would encourage you to connect the folks here to see what's her topics they are here I know we heard some of that to the testimonies are ready. I want you know that I personally would very supportive of that. Ay it discussions or discussion or questions? just wanted to me under comforter that I did make a motion to King. Think things I mean, I made a motion to close the public program. We have yet to vote on that items. I just want to be able to bring us back to the motion.

Was there. To close about hearing and room. But you chose to separate the pblic hearing from closings. I'm just going to once again make a motion to approve move U. S.. Ally. Great things. Chair Johnson, a hearing on that. So motion from I Chair Johnson too. Approved this agenda item all in favor. Aye. host 6 in favor. None oppose. The resolution is adopted item. 27 resolution. Rl Ha 26 dash one. 55 ratifying the Appeal. Special Tax Assessment for property at 5.65 Ldn Street. The assessment in this case is for boarding structure. boarding happened. started at this. You have to interrupt the sporting situation. So I make sure that they don't conflate them. In this case. We had a Colin from the apartment building that they

Live in. And the that they heard somebody trying to break into the building. The resident who is calling did have English as a second language. And there were some. Translation issues going on. It was happening, but it wasn't smoothest in the world. Police went to the property and found that the laundry room window had been broken in hand. It was unclear if somebody had entered in or not, that it had been broken into the owner in their appeals that the police department should have tried harder to reach out to them, to be able to do the boarding on the building. What the police department does in these cases is they will call for a boarding and hopefully they're able to have time to be honor to be able to have the owner come into it. But these are considered emergency situations where they need to act quickly to secure the building, to be able to move on to the next call of service.

And that's what happened in this case. The building was secured. And they moved and the owner believes that they could have done it. We're quickly more cheaply and so on. total amount of the assessment that's in front of By the way, is $479. The cost of the city was built for. Was $250 for the emergency call service and simply $60 for the secure it. Thank you. Before we move on to the public hearing, you want to see if there's any. Discussion any questions from this morning. First. For comment. Thank President U. S. moment. Just quick question.

In the record, the police department dollars policy. is no allegation that there that they did not call the policy. meant standard operating procedure was followed. Thank you. thank you all will hold a public hearing for this. If you're here test by. Come on up to the microphone, show your name where you're coming from and then sign in. My name is Laura Schroder Beyonce manager for that property. I got a copy of the police report. The police report does not state what phone number they dialed. It just says they called it left a voicemail. In my voice mail. specifically says that there's an after his emergency. Please dial this number. There's no record that they dial that. I tried to get a. Verification from the police department. What number they did dial and they they never responded. We would have we have an after-hours emergency service that will come on. Take care of all that stuff.

We are actually not trying to be a nuisance. We've got a homeless situation in the area. That is why the owner is. didn't get the call and we would have responded. That's thank you. there anybody else here to testify? Yes, come on up. Seeing none. Then I will take customer coming to a close the public hearing all in favor. All opposed 6 in favor. None public hearing is closed. comes from cover comment. Yeah, thank you. And thank you so much for being here testify. I also other people questions for moment and was able to move to approve our legislative hearing officer's recommendation in this This has come up a couple of times that, you know, in the last few months where people have felt frustrated urgent, important procedures. And I completely understand that. unfortunately, the at that moment of a legislative hearing is not the moment revise policies and think through how long do we want a police officer to spend making calls following the threat, get to somebody, Anderson, that the situation's very frustrating when they can be.

A sense that the differently. But as on the operating procedures followed, they come from ocean to come. Thank you. Any other discussion on this item. If not, I'll take that motion from councilmember comment for approval all in favor. I I all oppose 6 in favor. None opposed. The resolution is adopted. Item number. 33. Item, 33 are alleged 26 dash one. 52 ratifying the Appeal. Special Tax Assessment for property at 99, California Avenue West. president considers 99, California is very similar to the previous case. And this situation, we have a disorderly person who was at

The building in related in the police report was pounding on the apartment door and did break glass and the police were deployed make sure that the door was secured in this particular situation. We have the same kind thinking about calling the landlord and not calling the landlord. We don't have a deeper police report. This is a thing that's under investigation right now. So we have one of those brief two-sentence statements as Proceeds so what I can say is there was a break the police want, are the door was secure and It is in the same amount as previous assessment that you just heard. Thank you staff report any questions for Mormon. Before we go to the public hearing.

Can't. What is My recommendation is to approve the assessment. This is a public hearing coming up with you here to testify. Yeah. 2 minutes. So share name where you're coming from and then sign and afterwards. Hello, my name is Zach and the facilities manager for And the Cares Village is one of the buildings that I work So the service people did install a piece of plywood on the broken portion of the gass. But the latch the door was broken into the building. Was that completely unsecured for anybody to get in, including the person that previously had gone. And even though that they were gone by the time that these that arrived. They left the pilot glass in the entryway and also shards of glass on the hallway and up and down the stairs, which are important pathways for the residents and their past. What you want to keep safe. The office number and the emergency number of holes in the entryway where the incident had occurred.

The police report does not specify whether or not a call is made. Does however, we do not have any record of calls. The property managers working at that time and emergency line is monitored. 24 7, if they had contacted us, a technician was on site when this happened, a technician would have been able to have location immediately resolve the issue much more quickly and thoroughly was as you are given that opportunity. We believe that the course of action that was taken. I was unnecessary and it was on safe for the residents. And so we would ask that the assessment remove. Thank you for coming here to testify sign in anybody else here to testify. He's seen a now take a motion for a customer, Kim, to close the public hearing all in favor. I all post 16 different post public hearing is closed. Any discussion or questions? Yes, the Station. house and record of really understand that there people all company reached out plan for that. And $79. work. There was no question the hearing process for payments to be divided over time.

Certainly that's something the council can do. It is not usual mnagement company or landlord making that request, especially the thin them out and this low oven and yeah. We appreciate that. Yeah at this. But I just don't feel the need to have. Police like delegation of the police were not called this point. I think the Fairly nominal Given the broken glass and the safety for the building side when approved the recommendation of the Legislative Council. There's motion on table. Is there any discussion or questions about that? He's

Seen and I will take that motion for approval of the recommendation all in favor. All opposed 6 in favor. None opposed. The resolution is adopted. In the other items this morning. And then this year, the 90's thing Rl H R why 6 Dash 16 amending second making finding on the appealed substantial abatement order for 9.47. Fremont Avenue and Council fi are I-25 dash 4, That's president council members. I for 7 from that was originally in from the council May seeking a grant of time it for rehabilitation. this on nooses, building the council mean a grant of time of 180 days with all of the conditions having done that for pass inspection work plan, financing, etc. At the conclusion of the 180 days when we come to the hearing to see debate that was at. There have been 0 progress on the amendment. At that point. It was in the summer. My recommendation to the council was to grant additional 80 days because we had updated plans and financing and so on.

To continue the five-thousand performance, the not asked that it be for to continue it. But to have an additional $10,000 performance to pass posted. We just follow up on this last month so that that would be 12 month follow-up. So your second 100, maybe they follow up and there little to no progress, according to inspectors. At that juncture, I came recommended to the council that with updated plans and financing and so on. I would recommend to the additional 180 is, but that the council forfeit $5,000 at the Post a $15,000 and continue to forfeit a monthly basis. $2500 for each month that it continues to be incomplete rehabilitation. went in front of you and was voted on it. What you're looking at now is the first $2500 forfeiture. That would result from an incomplete project because certainly has the latitude to be able to modify it that timing wise or But wanted to flag that this is because long-term, not compliance.

And this is owner who we have had Lacy rehabilitation within the past. Thank Does anyone have any questions for him this morning before we open up the public hearing? Come for week. Vice president a question not of just we're a T a again. I I just wanted to say aloud can to support the recommendation from Councilmember and just so much this. represents. But at this,

The first time as counsel record of all. Monthly. A statement monthly. A college like assessment on it. Can you give some context, particularly unfamiliar with just a cr if they can see building fee for 5,000 each year that tey have to post rate. But can you just that give some context while monthly. And if that monthly fee is what we're using to get them into compliance. And like what actually constitutes the costs for 250. on case like to do that. First question is the

Annual vacant building registration fee. That is a hair over $5,000. That is for anybody who is a category 2 in their second year. So significant repairs needed or a Category 3, which this is. So yes, that's an annual fee. Whether or not it's in front of council for order to remove you have to pay that fee. So setting that aside, if it comes in front of you as a proposed order to remove or repaired because dangerous and burn uses conditions. The code provides that you have. A $5,000 performance deposits posted. And just that it's performance deposits for 4 months being the key word there. Have there been 50% or more completed when you check that the 6 month Mark? The code provides lot of medically renews. We don't have to talk about all. If there's less than 50% progresses, the council's discussion about how they would handle that. What the choice of the council was to continue. The 5,000 did forfeit anything and added an additional 10 when there hasn't performance. You have that led to Here we are at one year. Plus a few months juncture and I am recommending the forfeiture plus periodic forfeiture. We have to use this once before in recent memory for me. And that was for

A word for property I want to something. that in that case it was $5,000 performance because think that was a $1000 increments that it was forfeited. It is an unusual tools to deploy in the only times I have recommended that this have long-term compliance and with its gentler 2 or more encouraging than for for entire on so. Hopefully provides for more. Timely completion at the rehabilitation. So, yes, that was not additional performance. The pass of the day when questioned the place. Thank you. thank I just want to clarify, we don't hve a motion on the table yet for this item. Anybody else have questions before we go into the public hearing. not, open up the public hearing. If you're here test by come on up to the microphone. You get 2 minutes. So should your name where you're coming from and then sign and afterwards. My name is J. Mitchell. Im here on Garza. furnished. Fremont. Just to give A little context about this whole the property. So the property was taken back in a foreclosure. And in that process time they can transfer from a category 2 to Category 3 The lender got the property back. So ten it was a Category 3. This isn't the first in command of. I think myself in moment met on the former spawn, which was 5,000.

Granting the first 180 days. If correct. During that period of time, is not just to history right during that period of time. The city went to the city had of when the issuing permits stuff like that for polling. Well, all which newly implemented was Pauley at the time we were trying to get it from a single-family house. multi-family dwelling. It just took too long. So by that time we get to that second period of time during that time, I was morning and she recommended up large upfront which we did post and we're trying to work through that portion of it everybody the home to single family home because duplex would take too long or multifamily in that period of time. Again, is just kind of history thing. Then we had actual search, right? So during this time, a lot of work forces just just took on life of its own. And it was very, very, very difficult.

Is why there wasn't a lot of work completed candidly also shows moment aware some of wear. But during that time of the winter to spring because all this time happens to fall between like November late October, November, December, in center, one of te foundation walls collapsed in. We want to appear it. We did have an inspection and Specter asked for Sandra Bland, structural engineers report on that during that time. You about to have to that is time. Teen. I just want to make sure that we what ask you have is there just after one plants I'm not contesting the $5,000 for fun. First forfeiture, I'm just asking for. To continue the 180 days. It was already granted some of 2500 per month because it's unrealistic to be able to get it done every 30 days. And that only take 4 months $2500 apiece on mask Thank you so much for clarifying that. Okay. This hearing on item number.

39 and anybody else here to testify on this. Seeing none. I will take counselor Johnson to close the public hearing all in favor. I all oppose 6, 7, post public hearing is closed any discussion or questions. Johnson. Thank Questions from a snowman. They just want to go back to. I had a chance to review the record had a chance to review the matter. And just some of the things that have been submitted. And I want to take latest indication. I have a new record from. From Mr. Mitchell included a time frame. I think it was back in July just that there would be within one month, a structural engineer report and complete it recommended repairs. Have we received that here? And the city. The structural engineers report. I don't know. I could look into that, but I don't know. Okay. And then also I would say that just from the timeline that was stated in July.

So just looking at us now being here in August, some of the things that outlined that the schedule that were given was within a 6 month time period I was here. That is for history. And for my colleagues who are looking at this matter, we took that action as a council December 10th to 180 days of 2025. So That would have after our. Cyberattack incident, but also during that time frame in December, we would have issue that 180 days that would have been, you know, you're going to through my quick math of space, which is why you started to receive some of the notifications in June with this matter being in front of us. And I think just overall like I have a couple questions about whether or not to some of the things aren't shared by the time I outline by now, if that was based off of the the record and should have received destruction and repair report. there should be recommended repairs completed.

Just curious isn't just based off of the letter that with that. in the record. Progress has been made. I think that'll be really informative to me on. The final recommendation. So I'm going to ask my colleagues one weekly over time just to get the updates on that only because appreciate recommendation I want to be able to And I just also want to know progress on on the property itself. Tis Morning. Council vice president councilmember and then when asking for this kind of Congress, that would mean that a building inspector and possibly trace inspectors as well would be to be deployed to be able to go to the property and make this kind of assessment. Usually those assessments take place is a part of an inspection with completed work. And I don't know how the schedule for building inspectors look to be able to go out and do this kind of follow up. We could them.

I don't know what the schedule will look like. And I will definitely do that. I would ask for two-week layover in that case, especially given that there's a holiday between now and then so that we can see if there's progress. The ultimately, though, and I would ultimately the only measure that matters i whether or not the city has issued a code compliance certificate. That's the finish line. You know, progress on the rehab is great, which we receive more than 0. But it's that certificate finishing their son. I will ask the partner safety inspections just for competition. The total amount right as 15,000. The total amount was 15,000. Yes, and the council in July for 55,000. I actually withdraw that previous motion under something that I would be amenable to the 2 weekly over and that mtter for. So make a motion for to clear lead over of this item and the storm and I would appreciate being able to be updated on schedule of like weather. Realistically, like to have a and specter be able to back out to the property. So just want to make sure that that's a realistic timeline.

People there's a motion on the table for 2 weekly over rigged Johnson. Is there any discussion? Seeing none all in favor? want all opposed. 6 in favor. None opposed. That item is laid over for 2 weeks. for many other items. Most recent item was number 36, just No, we did. Certainly time. If agenda could be scanned, trying to go down to the Wyoming address and you have a worth cases. Well, so either one.

My apologies. Streets are now ordering the agenda 44 is why only warning okay. And the record. 44 lhs Aon. 26 Dash 15 making finding on the appeal. Of Gary Graham's to a nuisance abatement order for 3.14, women Street East and Council fi are lhs 26 to 46. it is for consumers. This is a vehicle a bit in order for the property Wyoming here, the original orders were issued to the property owner at the beginning May of this year. My recommendation at that time and came to council spent to June 5th. There was a follow-up on resolution that to cancel mid-July heard it. Begin in July. The vehicles were not called on at that time. This is a rental property in a new that Mister Grimes, the owner of the property had been want you to get the tenant to remove the vehicles and when you had your second, you had that follow up on July 22nd.

An additional one month was spent by the council in order for the abatement to be completed. And so I don't know what the additional ask is at this point. But my recommendation noose not a fit and authorize the Department of Safety inspections to abate the nuisance. There's been several extensions Benton's case thank you. are there questions before we go into the public hearing? Mr. Mc I do have a question. Can you let us know what? What is the and the post a time when that the man has to occur by then? Simply the and parents all Now. All right. This is a public hearing. ahead and testify. Get 2 minutes. Well, I make a couple I know typically, you know, we really not to the council member in the war here, too. Weigh in on this.

I am having kind you know, sometimes these items they come up, don't know who comes and testifies that. I do want to assure that based on the testimony today, I feel comfortable with one weekly over for this. it sounds like Tuesday is the day that you're hoping to have that card be removed from the property. And so that would be my motion. And then if it comes that they I mean, that's how president to be here. So she will be here to make a difference to make a decision. Every so often I have really, really difficult cases to come in front of you. And this is one of as Barkley explain her circumstances that I'm going to summarize so that she can focus on a few specific kinds of things. It was 6 or 7 years ago that as far France failed. Getting the money together to do a furnace replacement was not something she could handle within her budget. What she did to keep her house was to buy space heaters and to use space heaters to warm. All wnter long. So we're looking at very large excel bill to pay for the electricity from space heaters for that many years. So we're coming up on a lot right now. Xcel has turned off the electric to the property. And it is summertime. What my recommendation to us because this is content in order vacate it based on lack of utilities is to rent to October. 1st, to have the electric restored or the property vacated October first is a day I picked because that's wen the cold weather rule chicks and that the state of Minnesota it seemed like a decent benchmark for when your heat should be up and running.

And this is again, an electrical shock. not natural gas because the furnace doesn't work. we did do or for all 4 as many agencies as we come up with. Customers can. Yeah, I just

Really appreciate you coming how to speak and it's hard to come downtown and juggle all the things and say your time and attention means a lot to me. I've been briefed on with the legislative hearing. Officer. It is an incredibly difficult case. I am interested the recommendation. But the thing that I'm a little nervous about to be honest as I don't know how strict or how proactive the cold weather rule kicks in. actually inclined to extend that a little bit to make sure that if there's anything that we would need to do to have. To Bambi that we be able to do that. Can you speak a little bit about like, yes, that the cold weather rules kicks and had one. But is like how how proactive? Is Excel energy with making sure that they are following rule. And what a little. little bit more of a buffer you know, be safe than sorry. Things that want to bring. first thing is that October first is the day for the kicks And so I thought tat that would be a good day for determining, you know, is your heat on for the coming winter.

Is your heat not on for the coming winter in terms of the cold weather rule itself that speaks to the laws that excel follows about when it can and cannot shot off. Utilities in this particular all cases, really, you have to come to an arrangement with excel and payments. What on Barclay has been told by Xcel? She to pay 10%. Of this bill and then can, you know, continue making payments every single month under substantial payments and she is not financially able to make that initial payment. And so and that's that bridge could be cross. It's going to be almost impossible to get that payment plan in place and to use the official cold weather rule to keep the power on. I would say also you should be aware that heating home with space heaters is extremely dangerous. Do we do it overnight when our furnaces break? course we do. That's where that Minnesota happens.

For entire winter's for years. there's just incredible risks, too. The house, the neighboring houses and someone buy heating in this way. So that is my concern. Moving into the winter season. So just can you clarify that? The Cold Weather protection period does start October first struck Saturday that started. It yes, I'm inclined to give just a little more flexibility of time, but also because I think I'd like my office, need to engage alittle bit more. I think they're resource and people that would be interested. So just for the sake of both my involvement in capacity. But also I think there's interest I'm going to give myself and you a little extra time. So make it to October 15th. And let's see what we can pull together for a plan. So I trying to think of motion to amend the recommendation of the hearing. Officer to extend the notice. What's one of the words and looking for The deadline for restoration of the utilities.

I can simply say cross out October 1st. Underline October, 15th isn't new. I would appreciate that. think would. So that thank you, Allison officer, that is my motion. I appreciate part my colleagues. Thank you. Councilmember can there's a motion on the table? Is there any discussion or questions from Councilmembers?

Have a kind. Thank you so much. I really appreciate you councilmember I can making a motion. really also appreciate you being cargo be courageous. And there are resources and come work and had mentioned. I know energy calition through excel. You know, she has the home squad. There are financial. Financial guidelines for that. But just but when the separation to shine up and testifying and it helps you get some of resources to help your situation. I also want echo the gratitude from my colleagues to thank you for coming to city Hall in testifying. He shared some very vulnerable experiences here.

And I'm sure it's very hard. just really commend you for continued to be resilient. And it's you're going through a lot. So take care of yourself, too. Ordering the rehabilitation of raising and removal of the structures at 9.14, Central Avenue West within 15 days after the August 1926, City Council public hearing. We joined the staff report. Yes, the staff report just my question. I want to confirm it has referred to September 15 in a Our recommendation if has met those conditions. It's This property is on. In front of you, it's an order to remove or repair the structure. So you'd be looking at the standard conditions that you always do. The person who came to testify at the legislative hearing. Valerie Adams, it came up from Chicago. She's a member of the family. There's several siblings who part of this. The property has yet to be probated from the 2 deceased donors of the property. it has been a rental property and tell became a vacant building. that has been for I mean, that's a couple of decades. What was reported by MS Adams at this juncture, it is still in title by the deceased donors and it would need to be probated.

And the first thing that needs to happen is the family would come into agreement about how all of that would work and to get sign-ups and everything. So that needs to happen. In the meantime, I set. If we can get the performance deposit posted. And you order your code compliance inspections. Then I will recommend the council give additional time for us to start sorting out these other matters. The code compliance inspection application. We got confirmation today that the application has received. So that was processed and that's me to recommend to that September. fault with not having been applied for is not clear that it was a mistake on the part of Ms Adams on the part of Department Safety and inspections. She indicated that she had gone to the department she posted the performance. The pause that she had also applied for the inspection. There's no record of that that didn't happen. And she did today are believe yesterday, cent. By priority Mail.

The application with a cashier's She has checked apologize and to go backwards. The reason that that wasn't posted as it was with a credit card in the department could take credit cards. Consent agenda item cited. Just want to commend you this moment forward the with the staff of on the fly. And that was really great. So and that brings us to end of our agenda, wondering if customers have any good news to share their Kuzma Johnson. Thank you. I just wanted share a little bit about our we had a record event past weekend on really well with folks that are coming out.

I know that what the City Council budget that's coming know, they'll be a lot of discussions and a lot of opportunities for those that I look forward to doing at the Budget Committee. I would invite just from the previous conversation, just at the end. I do appreciate when folks are able to come out to our council meetings and I would encourage for. Tat dialogue. Sessions of the topics that were given implore and encourage our chair and vice chair of the Public Safety Committee, too. You know, if there's interest into public hearing on items tat are not on the city Council agenda, that they would potentially utilize their space and opportunity within the public safety committee to do so because I think just when we're going through some of the discussions and some of the partnerships like, you know, over the lst few weeks, there's times where there's topic service for the and it takes away from folks who are here to testify or even to speak to their items every time that we do that, including we've had probably the most legislative hearing item folks in attendance.

So we just encourage folks, if there's interest doing like public hearings as well. You know, next week is a public safety committee and public safety meeting. That's happening on the 26 where into a topic for discussion and bringing those items off. absolutely can do that because we set the agenda for the community. You know, that strong of limitations of are here at the council meeting where often not only does items that are not warmer summer long test what it is not speaking to the item hand, does that actually open up rules? But like doing things like opening up with hearing, it's not just legally not recommended, but actually open us up to several things that we don't want to have to participate So that's often why gets cut off. And I think happens where there's not there's not a public agenda. I just want explain for folks who are here may be wondering how you know, get voices heard.

There's always an opportunity and a special people who are watching at home. I had several Several homes several public. Committee members before my ward and external that talking about. Topics any time. And you're welcome to do that. And in space. Coming into the council meetings without an agenda item and causing that disruption is something that I think has happened in the past. And I would just implore my colleagues to utilize the space opportunity like we do any other committee that we have. To provide that opportunity for anything that you want to hear about, including matters that could come above like FOX Security you know, contracts that we have because I know that at one of the things that I heard was something comment on the water board's item that has been talked about. The great point, I think through issues topic of flock cameras the council president isn't here, but it's already shared interest in doing that.

And so I just want to ensure informing the public to about how and what they can ask for. You can tell they asked for a public from apublic conversation any point time, but you can also do it at the Public Safety Committee meeting. Ad you know, I know with the chair and vice set the agenda, as you know, Council boy, I heard comments today and hope that folks reach out to you by having a public safety comment opportunity at the next public safety meeting next week. Thank you, conservatives. Yes, respond to that I think is really important. And want share with people what we review. As safety. Chair for community, we have had conversations we've had. This item agenda item we have by SUV t present. We have. So inviting. a county shares to present. I you know, with the limited time that we have for public safety committee, it's always opportunities and have And and our people want to lend their voice.

There have been hearing. But I know what in testimony is is more not just. A public safety matter like how we are entering into contracts and all we are using public dollars, taxpayer dollars is more like a broader conversation that exist in any committee. But for committee that we have next week. part to discussion for encampment response post review. So that is also very pressing issue. Want to say we can have a public hearing you don't actually have the time. Now. We had for years just in time we can do that. And also just being transparent well. How we actually posted agenda. Has to be a week in advance. So it would be today. We have to decide which council members would like to a public hearing. I do think direct come to meetings. He's having the best time just because we have pressing issues that we're going to be reviewing during the public safety meeting next week.

But in the future. Obviously people we have we heard from people who when asked to review flock cameras as get it. Vice chair and Coleman chaired meeting. And, yes, those questions, if there's further questions that buy, what they can ask any councilmember and there's not council member that's responsible to ensure that we have tansparency. I would also like to just say to outside of just this governing body or inside chambers as council members, we have opportunity to host town homes and have informal conversations. so. Some commitments are utilized. areas where there's a petition around, you know how we want to take policy actions. So I implore all ideas, but I do appreciate you're a thing that also want make make sure people are aware that we have reviewed this topic. This is not the first time we're hearing this. We have seen what other cities have done is for those opportunities for what we want to do during the council? All right. Any other news to share? If not, then that brings us to the end of meeting here out to get motion for considerably a bit. Well, almost fvor than oppose meeting is adjourned things. Everybody have a???
